The termination of employment relationships raises many issues in the everyday work of works councils. In addition to all forms of dismissal, works councils are often confronted with termination and settlement agreements. The seminar focuses on the key aspects of individual rights that must be considered when terminating employment relationships – in particular dismissal. This seminar highlights different forms of dismissal, dismissal protection law and the associated participation opportunities of the works council.
Themenplan:
- Termination by the employer: Forms of dismissal, form, notice period, receipt and grounds for dismissal, requirements for the applicability of the Dismissal Protection Act, special protection against dismissal, participation rights of the works council and dismissal protection proceedings, reference, working papers, certificate of employment, remaining leave, overtime, time off to look for a job, compensation for damages if applicable
- Termination by the employee: Form, deadline, reason and receipt; contractual penalties, repayment clauses, damages; blocking period according to SGB III
- Termination agreement: Form and content (e.g. severance pay, leave of absence, termination of employment, certificate), blocking period and suspension period according to SGB III, tax treatment of severance pays Right to fixed-term contracts: Fixed-term employment without objective reason and fixed-term employment with objective reason, new case law on previous employment, requirement of written form, termination options, action for termination of contract
