When hiring new employees, the works council must deal with various questions and legal aspects. What needs to be considered before concluding the employment contract? How is the employment relationship established and what content must be included in the employment contract? The seminar covers the essential basics of labour law and takes a closer look at the process of hiring a new employee – from the job advertisement to the job interview to the employment contract from the works council’s point of view and highlights the tasks, rights and options for action by the works council.

- Monitoring tasks and participation rights of the works council
- Clarifying terms: Company, enterprise, employee, temporary worker, trainee, marginal employee, freelancer
- Pyramid of standards
- Collective and individual labour law, collective bargaining and collective bargaining reference, works agreements and collective bargaining priority, position of trade unions
- Primary and secondary obligations of employee and employer
- Establishing employment relationships: job advertisements, right to ask questions, etc.
- Form of employment contract, Evidence Act, de facto employment relationship
- Special bases for claims: overall commitment, company practice, principle of equal treatment
- Content review: provisions under GTC law such as contractual penalties, repayment of training costs, health checks, exemption regulations, etc.
